Terms & Conditions

Unless otherwise defined, the terms used on this page apply to these Terms & Conditions of Use.

"Platform" means the www.trumecs.com website and the TRUMECS mobile application. "Services" means all services made available through the Platform, including product information, product search, quotation preparation, and other related services.

You agree to comply with all guidelines, notices, operating rules, policies and instructions relating to the use of the Services and/or access to the Platform, and any amendments to them, which we issue from time to time.

We reserve the right to revise such guidelines, notices, operating rules, policies and instructions at any time. You are deemed to have read and accepted any such change once it has been notified or published on the Platform or through other channels.

You agree that you will NOT:

• Impersonate any other person or entity, provide false information, or claim to represent any other person or group.
• Use the Platform or Services for any unlawful purpose.
• Attempt to gain unauthorised access to, or interfere with or disrupt, any computer system or network connected to the Platform or Services.
• Post, advertise or transmit any prohibited material through the Platform or Services.
• Interfere with the use or enjoyment of the Platform or Services.
• Use or upload any software or material containing, or suspected of containing, viruses, destructive components, malicious code or other harmful components that may damage data, disrupt other Customers' computers or mobile devices, or disrupt the Platform or Services.
• Use the Platform or Services in breach of the usage rules or policies of any computer network, internet standard, or applicable law.

We may enhance, modify, suspend, discontinue or remove, in whole or in part, the Platform or Services without giving any reason or prior notice.

We are not liable if such enhancement, modification, suspension or removal prevents you from accessing the Platform or any part of the Services.

We may, but are not obliged to:

• Monitor, filter or control any activity, content or material on and/or through the Platform.
• Investigate any breach of these Terms & Conditions at our sole discretion and take any action we deem appropriate.
• Prevent or restrict a Customer's access to the Platform and/or Services.
• Report activity suspected of breaching applicable laws to the relevant authorities and cooperate with them.
• Request information and data from you in connection with your use of the Services and/or access to the Platform at any time. If you refuse to provide such information, or provide inaccurate, misleading or fraudulent information, we may draw the relevant conclusions and act accordingly.

Your use of the Services and/or access to the Platform is also subject to our Privacy Policy as set out on the Privacy Policy page.

In addition to these Terms & Conditions, certain specific aspects of the materials and Services, or more comprehensive or updated versions of materials offered by us or our designated subcontractors, may be subject to additional terms which apply in full.

Use of the Services is limited to Customers who are legally of adult age and who have the legal capacity to enter into and be bound by agreements under applicable law.

Customers who breach these Terms & Conditions, or who are permanently or temporarily suspended from using the Services, may not use the Services even if they otherwise meet the requirements above.

By using the Services you agree:

• To access and/or use the Services only for lawful purposes and in a lawful manner, and to conduct any activities relating to the Services in good faith.
• To ensure that any information or data you provide, post or publish on the Platform in connection with the Services is accurate, and to accept responsibility for such information and data.

We always strive to provide accurate product descriptions. However, we do not warrant that such descriptions are accurate, current, or free from error.

All listed prices are subject to applicable taxes unless otherwise stated. We reserve the right to change our price list at any time without giving any reason or prior notice.

You acknowledge that parties other than Trumecs (Third-Party Vendors) may register and sell products on the Platform.

For the avoidance of doubt, any transaction or agreement for the sale of a Third-Party Vendor's product to a Customer is made directly between the Customer and the Third-Party Vendor, and binds only those two parties. Trumecs is not a party to that agreement.

Certain Services available on the Platform require you to create an account or to provide your Personal Data.

The Username and Password may be created and provided by us, or chosen by you and accepted by us at our absolute discretion in relation to the use of the Services.

We may at any time require you to update your Personal Data, or cancel your Username and/or Password without prior notice. We shall not be liable for any loss arising in connection with such cancellation.

You agree to:

• Change your Password periodically.
• Keep your Username and Password confidential and take responsibility for the security of your account.
• Be responsible for any disclosure or use of your Username and/or Password, including any use that you did not authorise.
• Contact us immediately if you discover or suspect that the confidentiality of your Username and/or Password has been compromised, if there has been unauthorised use, or if your Personal Data needs to be updated.

You agree and acknowledge that any use of the Services and/or access to the Platform referencing your Username and Password will be treated as access and use by you, or as a lawful posting, disclosure, or provision of information, data or communication issued by you.

You agree that we may, but are not obliged to, treat any use made under your Username and Password as being made by you, provided there is no prior substantiated report of unauthorised use of your account. We may conclude that such use was made or sent by you and hold you accountable for it.

You further agree and acknowledge that you are bound by and fully liable for any loss arising from any use of the Services and/or access to the Platform under your Username and Password.
